01

Acceptance of Terms

By accessing or using the website, services, or platforms operated by Infatix ("Company," "we," "us," or "our"), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please discontinue use of our services immediately.

These terms apply to all visitors, clients, partners, and others who access or use our services across India, UAE, and Canada.

02

Services Provided

Infatix offers digital marketing, public relations, social media management, search engine optimisation, CRM development, web development, app development, and related consulting services.

All service deliverables, timelines, and scope are defined in individual client agreements or statements of work (SOW). These Terms and Conditions govern the general use of our digital properties and supplement — but do not replace — any signed client contracts.

03

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the exclusive property of Infatix or its content suppliers and is protected by applicable intellectual property laws in India, UAE, and Canada.

Client-specific deliverables (such as custom designs, copy, and code) become the property of the client upon full and final payment unless otherwise stipulated in the applicable service agreement. Infatix retains the right to showcase completed work in its portfolio and marketing materials unless the client requests otherwise in writing.

04

Client Obligations

Clients engaging Infatix agree to:

• Provide accurate, complete, and timely information required to perform the agreed services. • Ensure that all materials shared with Infatix (images, copy, data, credentials) do not infringe upon any third-party rights. • Designate a point of contact responsible for approvals and feedback. • Adhere to agreed payment schedules as outlined in the service agreement.

Delays caused by incomplete client inputs may affect delivery timelines and are not the liability of Infatix.

05

Payment & Refund Policy

Fees for services are detailed in individual proposals or service agreements. Standard payment terms require a non-refundable advance before project commencement.

Refunds are evaluated on a case-by-case basis. Infatix does not guarantee refunds for services already rendered, approved, or where work has commenced. Disputes regarding invoices must be raised within 7 calendar days of the invoice date. Late payments may attract interest as per the applicable jurisdiction's commercial laws.

06

Confidentiality

Both parties agree to maintain strict confidentiality regarding proprietary information, business strategies, client data, and any sensitive materials shared during the course of the engagement.

Infatix will not disclose client information to third parties without express written consent, except where required by law or regulation, or where disclosure is necessary to provide the agreed services (e.g., platform integrations, ad network access).

07

Third-Party Platforms & Tools

Infatix may use third-party tools, platforms, APIs, and services (including but not limited to Google Ads, Meta, LinkedIn, CRM systems, and hosting providers) to deliver its services. The use of these platforms is subject to their respective terms of service and privacy policies.

Infatix is not liable for outages, policy changes, account suspensions, or data losses caused by third-party platforms.

08

Limitation of Liability

To the fullest extent permitted by applicable law, Infatix, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, loss of data, or business interruption — arising from the use of our services.

Our total aggregate liability for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by the client for the specific service in question during the three months preceding the claim.

09

Termination of Services

Either party may terminate a service engagement by providing written notice as specified in the applicable service agreement. Upon termination, the client shall pay for all services rendered up to the termination date.

Infatix reserves the right to suspend or terminate services immediately if a client breaches these Terms, engages in unlawful activities, or fails to make timely payments.

10

Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of India. For clients in the UAE, applicable UAE commercial laws govern engagements in that jurisdiction. For clients in Canada, applicable Canadian federal and provincial laws apply.

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be referred to arbitration or the competent courts of the respective jurisdiction.

11

Amendments to These Terms

Infatix reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on our website. Continued use of our services following any change constitutes your acceptance of the revised terms.

We encourage you to review this page periodically to stay informed about your rights and obligations.
